Prices, Costs, Conditions and Delivery Time

The prices in force are those displayed on the store at the time of the order. All prices are expressed in Swiss francs and VAT is included. Packaging and shipping costs (currently CHF 14.00) extra.
Fruit-Fantaisie Sàrl delivers exclusively in Switzerland.
The goods are generally delivered to the Post Office within 48 working hours and sent directly to the delivery address indicated by the customer on the order form. The indications relating to the delivery time are non-binding. Fruit-Fantaisie Sàrl declines all responsibility in the event of late delivery.

Terms of Sale

1. General, scope

1.1. The general conditions (hereinafter the "GTC") apply to all services provided by Fruit-Fantaisie Sàrl relating to product orders on its online store. The shipment of an order through the online store constitutes acceptance of these general conditions by the buyer.

2. Offers and conclusion of the contract

2.1. The online store offer is subject to product availability. The contract is concluded with the buyer when Fruit-Fantaisie Sàrl accepts the customer's order. The e-mail received after the order is a simple confirmation of receipt and not an acceptance of the order by Fruit-Fantaisie Sàrl. The acceptance of Fruit-Fantaisie Sarl occurs through the delivery of the goods. If a product is not available at the time of dispatch, the customer will be notified to choose an alternative or refund.

3. Price

5. Risk transfer, delay in acceptance

5.1. The goods are sent to the delivery address indicated when ordering. The risks relating to the goods are transferred with the delivery of the goods for shipment to the customer.

5.2. If the goods cannot be delivered to the customer at the delivery address indicated or if the customer refuses them, Fruit-Fantaisie Sàrl is not required to make a new delivery attempt. A new delivery attempt will be billed to the customer.

6. Payment terms

6.1. Fruit-Fantaisie Sàrl provides several choices for payment.

6.1.1. Payment can be made by bank credit card (Visa, Mastercard, American Express), PayPal or Twint.

6.1.2. Wire Transfer. In this case the order will be processed upon confirmation from the bank for receipt of the value of the goods ordered. Bank details can be found on the order receipt email. The delivery time will be longer.

6.2. Partial payments are not allowed.

7. Guarantee and ownership

7.1. The customer is obliged to check the goods upon receipt.

7.2. If the goods are not compliant or not consumable, Fruit-Fantaisie Sàrl is free to choose between replacing the goods or providing a corresponding credit note, provided that the customer has returned the goods. All other claims of the customer are expressly excluded.

8. Exclusion of liability

8.1. Fruit-Fantaisie Sàrl is liable to the customer only for delivery errors due to negligence. In any event, liability is limited to compensation for direct damage and to the selling price of the delivery concerned. The responsibility of Fruit-Fantaisie Sàrl is limited to the good packaging of the products and a reasonable expiration date.

9. Data protection

9.1. All personal data collected on the online store is used exclusively to serve and support the customer in order to meet his wishes. As the operator, Fruit-Fantaisie Sàrl guarantees the customer that their information is treated confidentially, in accordance with the legal provisions governing data protection.

9.2. In principle, the transmission of personal data of the customer to third parties is excluded. The transmissionto persons directly involved in the execution of the order or to collection offices in the event of legal proceedings is an exception.

9.3. By ordering, the customer declares that he accepts to receive information for commercial and other purposes by various means of communication (e-mail, mail, telephone, sms) from Fruit-Fantaisie Sarl. The customer can unsubscribe at any time by simple message to the specified contact address.

10. Modifications and additions

Fruit-Fantaisie Sàrl reserves the right to adapt these GTC to the circumstances at any time and to immediately apply the new version. The customer is required to inform himself about the GTC in force with each order.

11. Applicable law, competent court.

11.1. This Agreement is governed by Swiss law.

11.2. In the event of a dispute, the place of jurisdiction is Forel (Lavaux).
